Summary Case heard on 13/12/04. Waste transfer station. Employee was attempting to clear blockage of paper & cardboard at the top of a hopper over a baling machine. He stood at the edge of inclined conveyor & hopper & kicked blockage to clear it, falling into the baling chamber with the cardboard. The ram activated & amputated both legs below the knees. Baler was not isolated. Conveyor had been switched off using emergency stop but baler still powered. No risk assessment or safe system of clearing blockages, no training. Supervisors & staff routinely kicked blockages to clear. No tripwires on conveyor, insufficient guard at mouth of hopper. Breach of HSWA S.2 Fine of £80,000 plus £20,505.41 costs.
